The petitioner seeks bail in connection with Araria P.S. Case No. 410 of 2020 dated 31.05.2020 instituted for the offences under Sections 379 and 411 of the Indian Penal Code.

The petitioner is in custody since 31.05.2020. The motorcycle of the informant is stated to have been stolen. The suspicion was on the petitioner and when the informant tried to masquerade himself as a buyer of the vehicle, he was told by the petitioner that he is ready to sell

Patna High Court CR. MISC. No.34467 of 2020(2) dt.21-12-2020 2/2 the motorcycle for Rs. twenty thousand. In that connection, the petitioner is said to have come with the motorcycle, when he was caught by the public.

Learned counsel for the petitioner has submitted that the informant is none else but a tenant of the petitioner whom the petitioner wants to evict from the house. The present case is only an offshoot of the dispute between the landlord and the tenant.

Be that as it may, regard being had to the nature of accusation and period of custody of the petitioner and also taking into account that the petitioner is a person of clean antecedents, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Araria P.S.
