JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, he was arrested with country made liquor and one motorcycle bearing Registration no. JH 10AG/7573 and for the aforesaid recovery, Agiaon (G) P.S. Case No. 50 of 2015 was registered against the petitioner.

Learned counsel for the petitioner submits that in the present case, vehicle bearing Registration no. BR03J/9202 had been stolen and the registration number of seized motorcycle does not tally with the present stolen motorcycle nor the investigating officer took any step to ascertain this fact as to whether the seized motorcycle was stolen property of the present case or not.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara Town P.S. Case No. 140 of 2015.
