JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-02-2016 Heard learned counsel for the petitioners and the State.
The petitioners being the brothers and married sister of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code. Accusation is of killing the daughter of the informant after two years of marriage for non-fulfillment of dowry demand as Motorcycle and Freeze.
It is submitted by the learned counsel for the petitioners that the thrust of accusation is against the husband of the victim. The petitioners claim to be separate from the
Patna High Court Cr.Misc. No.4407 of 2016 (2) dt.01-02-2016 victim's husband and they were at Delhi on the alleged date of occurrence. The petitioner no. 5 is married sister of the husband of the victim, who is residing in her matrimonial house and co-accused have been granted anticipatory bail by a Coordinate Bench of this Court vide Cr. Misc. No. 46789 of 2015.
Considering the thrust of accusation is against the husband of the victim, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistratecum-Sub-Judge-IV, Muzaffarpur in connection with Sakra P.S. Case No. 163 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Dinesh Kumar Singh, J) P.K./- U T
