The petitioner seeks bail in connection with Sonbarsa P.S. Case No.136 of 2016 registered for the offence punishable under Sections 420, 409 and 406 of the Indian Penal Code. Considering the specific allegation made in the first information report against the petitioner that being Cashier of the Allahabad Bank, Branch-Matiyarkala, he defalcated Rs.26,00,000/-, I am not inclined to grant him bail for the present even though he is in custody since 27.02.2019. The prayer for bail is rejected.

The learned Chief Judicial Magistrate, Sitamarhi is directed to expedite the trial of the petitioner and conclude the same within nine months from the date of receipt/production of

Patna High Court CR. MISC. No.40289 of 2019(5) dt.20-11-2019 2/2 a copy of the order, failing which the petitioner shall be at liberty to renew his prayer for bail.
