JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 01-12-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for grant of regular bail arises out of Karghar (Sidhi) P.S. Case No. 124 of 2011 (Sessions Trial No. 464 of 2015), disclosing offences under Section 395 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has been implicated in the present case on the basis of confessional statement of the co-accused Doma Musahar. He submits that the petitioner has no criminal antecedent and said Doma Musahar, who is said to have made confessional statement before the Police, has been granted regular bail by this

Patna High Court Cr.Misc. No.46017 of 2015 (3) dt.01-12-2015 2/2 Court vide order dated 29.01.2013 passed in Criminal Miscellaneous No.49109 of 2012. The petitioner is in custody since 18.06.2015.

Considering the submission as above, this application is allowed.

Let the petitioner, above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VII, Rohtas at Sasaram in connection with Karghar (Sidhi) P.S. Case No. 124 of 2011 (Sessions Trial No. 464 of 2015).

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
