2. The petitioner has preferred this application for grant of regular bail in connection with Kumarkhand P.S. Case No. 71 of 2025 dated 11.03.2025 registered for the offences punishable u/ss 8(c), 21(a) of the NDPS Act.

3. As per the prosecution case, total 3.3 grams of smack and a mobile phone from the possession of the coaccused Satyam Kumar, total 14 Puriya of 1.4 gm. of smack and Rs. 4150 /- from the possession of the co-accused Mithlesh Kumar and a mobile phone and aluminium wrapper from the possession of the petitioner were recovered.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.35811 of 2025(2) dt.18-06-2025 2/2 that the petitioner is innocent and has falsely been implicated in this case. The seized contraband has not been recovered from the possession of the petitioner rather the said recovery was made from the possession of the other co-accused persons. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 10.03.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner who had no valid authorization for keeping the said contraband.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Madhepura in connection with Kumarkhand P.S. Case No. 71 of 2025.

7. The application stands allowed.
