The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.

As per the prosecution case, while the informant was returning from the Bank after having kept Rs.1.63 lacs in cash and carrying the same to the C.S.P. Centre, it is stated that the four accused persons looted the same.

It is submitted by learned counsel for the petitioner that the F.I.R. was registered against four unknown. In course of investigation, on the basis of information provided by the spy, three accused persons including one Rahul Kumar were arrested and it is on the confessional statement of the said accused persons including Rahul Kumar that the name of the petitioner

Patna High Court CR. MISC. No.46197 of 2021(3) dt.03-03-2022 2/2 transpired. Co-accused Rahul Kumar has been enlarged on bail vide order dated 29.6.2021 passed in Cr. Misc. no.7400 of 2021. The petitioner has not been put on T.I. parade. He is in custody since 1.7.2020.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the material that has transpired in course of investigation and the petitioner having remained in custody for 1 year 8 months, the Court directs the petitioner to be enlarged on bail in connection with Mahua P.S. Case no.647 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali.
