JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-08-2019 This is an application for grant of anticipatory bail in connection with Sikandra P.S. Case No.182 of 2018, disclosing offences under Sections 272 & 273 of IPC and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Prosecution case is that police on information that huge quantity of liquor is being brought by way of Lachuwar Janam Asthan and on that, police party raided the place of occurrence and saw one vehicle coming, seeing the police party, the accused persons succeeded in fleeing away. Further from the vehicle 169 liters of liquor and one A.T.M. Card of SBI and Driving License of the petitioner were recovered. Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case and having no criminal antecedent.

Having heard both sides, considering the fact that Driving License and ATM Card was of the petitioner were recovered from the seat of the driver of the vehicle, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail.
