The petitioners are accused in connection with Bhojpur Mahila P.S. Case No. 148 of 2013, registered under Section 304(B), 498(A)/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The accusation is of killing of Anita Devi, daughter of the complainant/informant, namely, Bhagwan Sonar due to non-fulfillment of demand of dowry by her husband and in-laws and to dispose of her dead body.
Learned counsel appearing on behalf of the petitioners submits that both the petitioners are father-in-law and mother-in-law of the deceased and they are in custody since
Patna High Court Cr.Misc. No.46959 of 2015 (3) dt.12-02-2016 17.06.2015 and 09.07.2015, respectively. Further submission is that, in fact, deceased was a feeble mind and she left her sasural and due to ulterior motive, the present case has been lodged. Moreover, husband of the deceased Amar Sonar is in custody, which would appear from order dated 28.08.2015 by which the prayer of petitioners had been rejected by the Court of Session. Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur (Ara) in connection with (Bhojpur) Mahila P.S.
