JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-09-2019 The present writ petition has been filed for removing encroachment from the public land used for Aam Rasta which has been encroached by the private respondent nos. 8 to 13,

Patna High Court CWJC No.11446 of 2019(2) dt.03-09-2019 2/2 details whereof are as follows:- "Village-Nonahar,P.S.-Suryapura, Anchal-Bikramganj, Thana No. 326, District-Rohtas, Khata No. 878, Plot No. 2938, Area-78 Decimals."

The learned counsel for the petitioner submits that the aforesaid encroachment had already been removed by passing of an order dated 13.08.2018 by the Circle Officer, Bikramganj, however, the private respondents have again made encroachment over the public land.

Having regard to the facts and circumstances of the case, I deem it fit and proper to grant liberty to the petitioner to approach the Circle Officer, Bikramganj by filing appropriate application under the provisions of the Bihar Public Land Encroachment Act, 1956 whereupon necessary action would be taken by the Circle Officer, Bikramganj, District-Rohtas and in case it is found that the encroachment has been made again, the same shall be removed forthwith.

The writ petition stands disposed off on the aforesaid terms.
