JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-03-2021 Heard Mr. Uma Shankar Singh, learned counsel for the petitioner and Mr. Deepak Kumar Singh for the informant. The State is represented by Mr. Shantanu Kumar, learned APP.

The petitioner seeks bail in anticipation of his arrest in connection with Birpur (Begusarai) P.S. Case No. 33 of 2020, POCSO Case No. 22 of 2020 dated 23.03.2020, instituted for the offences under Sections 376/34 of the Indian Penal Code and Sections 4, 8 and 12 of the POCSO Act.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this petition in order to enable the petitioner to surrender before the court below and seek bail.

Should such an application be filed, it shall be

Patna High Court CR. MISC. No.33693 of 2020(2) dt.18-03-2021 2/2 heard on its own merits including that the petitioner is an agnate of the informant and the court below shall pass orders in accordance with law without being prejudiced by the fact that the present petition has not been entertained.

The petition stands dismissed as withdrawn with the liberty aforesaid.
