JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-08-2019 This is an application for grant of anticipatory bail in connection with Laxmipur P.S. Case No. 301 of 2018, disclosing offences under Sections 341, 323, 308, 504 and 34 of IPC.

Prosecution story is that there was a scuffle going on at the house of the informant and when the informant enquired about the same, petitioner and other accused persons abused him and petitioner assaulted him on his head, causing injury. Submission of the learned counsel for the petitioner is that there is no specific allegation against the petitioner and there is case and counter case between the parties. Further submission is that there is no allegation of repeated assault to any person and from both sides have received injury. Heard learned A.P.P. also.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.34953 of 2019(4) dt.08-08-2019 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Sri S.K. Singh, learned Judicial Magistrate, 1st Class, Jamui, in connection with Laxmipur P.S. Case No. 301 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
