The petitioner has preferred this application for grant of regular bail in connection with Jokihat PS Case No 96 of 2022 dated 24.02.2022 registered for the offence punishable under Sections 392, 412/34 of IPC.

As per the prosecution case, three miscreants assaulted the informant, took away Rs 4000/- and the pick up van loaded with articles worth Rs 7 lacs.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has one antecedent, as stated in paragraph 3 of the bail petition in which he is on bail. He is in custody in

Patna High Court CR. MISC. No.36685 of 2023(2) dt.07-07-2023 2/2 this case since 03.04.2023. It is further submitted that the name of the petitioner has transpired in the statement of co-accused. Nothing has been recovered either from the possession of the petitioner or from his house. He has not been put on TI Parade. The co-accused Karul @ Karool @ Wasik has been granted anticipatory bail by the co-ordinate Bench of this Court vide order dated 07.12.2022 passed in Cr Misc No 41309 of 2022. Learned APP has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, the period of custody as well as the nature of allegation against the petitioner, the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in Jokihat PS Case No 96 of 2022 dated 24.02.2022. This application stands allowed.
