JUSTICE RAKESH KUMAR ORAL ORDER 04-11-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor.

This is second attempt for grant of bail on behalf of the petitioner. Earlier, prayer for bail of the petitioner was rejected on 4.2.2015 vide Cr. Misc. No. 44891 of 2014. By the same order this court had extended the privilege of bail to one of the co -accused namely Rana Singh @ Ranvir Kumar Singh vide Cr. Misc. No. 44761 of 2014.

Learned counsel for the petitioner emphasizes that informant had not seen the occurrence and petitioner has falsely been implicated. He further submits that till date two witnesses have already been examined.

Keeping in view the fact that on merit the prayer for bail of the petitioner was rejected, there is no point to examine

Patna High Court Cr.Misc. No.46178 of 2015 (4) dt.04-11-2015 2/2 again the merit of the case. Since trial has already commenced, I do not find it a fit case to extend the privilege of bail to the petitioner.

The petition stands dismissed.
