JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 504, 506, 34 of the Indian Penal Code and Section 7 of the Protection of Children From Sexual Offences Act, 2012. The prosecution case is that the petitioner put the finger on the private part of the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that petitioner is cousin of the informant and due to the petty dispute the accusation has been levelled. It is further submitted that from the materials available on record, it appears that the victim was not examined by the doctor as there is no medical report on the record. The impugned order also does not suggest that any medical examination of the victim was done.

Patna High Court Cr.Misc. No.1807 of 2016 (2) dt.14-01-2016 2/2 A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Digha P.S. Case No. 320 of 2015, pending in the Court of learned Additional Sessions Judge-I, Patna.

With the observations above, the application stands disposed off.
