ANJANA PRAKASH ORAL JUDGMENT Date: 11-05-2015 The Petitioner seeks revision of the judgment and order dated 2nd August, 2003, by which the 6th Additional Sessions Judge, Patna, in Cr. Appeal No.84 of 1997 has affirmed the judgment and order of conviction dated 28.04.1997 passed by the Sub-Divisional Judicial Magistrate, Patna City, in CB Case No.117 of 87/ Tr. No.23-A of 1997, by which the Petitioner was convicted under the provision of Food Adulteration Act and sentenced to rigorous imprisonment for one year with fine of `1,000/-. In view of nature of allegation against the Petitioner and no perversity in the impugned judgment, I see no reason to interfere in the same on merit.
However, considering that the Petitioner has remained in custody for substantial period and the occurrence is of the year
Patna High Court CR. REV. No.673 of 2003 dt.11-05-2015 2/2 1986, sentence of the Petitioner is reduced to one already undergone by him.
The Revision Application is dismissed with the aforesaid modification in the sentence.
