2. The present criminal miscellaneous application has been filed under Sections 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of regular bail to the petitioner who is in custody in connection with Lalganj P.S. Case No. 501 of 2024, lodged on 25.12.2024, under Sections 96/3(5) of the of the Bhartiya Nyay Sanhita, 2023.

3. As per the prosecution, FIR has been lodged against eight named accused persons including the present petitioner against whom allegation is that the petitioner and other accused

Patna High Court CR. MISC. No.36344 of 2025(3) dt.06-08-2025 2/3 persons have kidnapped the grand-daughter of the informant with a view to sell.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that the petitioner is in custody since 28.12.2024 having clean antecedent. Counsel submits that in the rejection order passed by the Sessions Court it has been acknowledged that the alleged victim has been recovered and in her statement under Section 180 and 183 of the "BNSS" she has accepted that she went with the petitioner with consent.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that case-diary may be called for.

6. In her statement under Section 183 of the BNSS the victim has accepted that she went with the petitioner with consent.

7. In the present facts and circumstances of this case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of I/C. Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Lalganj P.S. Case No. 501 of 2024,
