JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 448, 323, 324, 504, 506, 354A, 354B, 307, 380 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
The accusation against the petitioners is of abusing and assaulting the informant. It is further alleged that they started firing but nobody was injured. It is specifically alleged that Sadhu Sao assaulted with sickle causing injury to the informant. It is submitted by the learned counsel for the petitioners that background of the accusation leveled is land dispute. The injury report reflects only one injury is simple in nature caused by
Patna High Court Cr.Misc. No.2759 of 2016 (2) dt.19-01-2016 2/2 hard and blunt substance and there is counter version of the occurrence but no statement has been made to this effect in this petition.
Considering the facts aforesaid, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J. II, Sheikhpura in connection with Barbigha P.S. Case No. 419 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J.) KKSINHA/N.H.
