JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-08-2019 Heard learned counsel for the petitioner, learned Additional Public Prosecutor and perused the case diary. The petitioner is in custody in connection with Sasaram (M) P.S.Case No.03 of 2019 registered for an offence under sections 302, 201 and 34 of the Indian Penal Code. The prosecution case is that on 31.12.2018, the son of the informant Amarjit Ram, this petitioner along with four coaccused persons went near the Amra Talab and did not return to his house thereafter in the next morning, his dead body was lying in the railway line.

It is submitted on behalf of the petitioner that there is suspicion against this petitioner to commit the murder of informant's son. There is no eye witness to the alleged occurrence. It is further submitted that in course of

Patna High Court CR. MISC. No.34328 of 2019(5) dt.28-08-2019 2/2 investigation, no incriminating article has been recovered from the possession of the petitioner. Petitioner is in custody since 21.01.2019.

In the view of the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas, Sasaram in connection with Sasaram (M) P.S.Case No.03 of 2019 with condition that the petitioner shall fully cooperate in the trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
