JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-12-2020 Heard learned counsel for the petitioner as well as learned A.P.P. for the State through video conferencing. The petitioner seeks bail in Sitamarhi P.S. Case No. 97 of 2020, registered for the offence punishable under Sections 399, 401 and 414 of the Indian Penal Code and Section 20/22 of N.D.P.S. Act.

As per the prosecution case, one motorcycle without number, one mobile phone as well as 18 small packets of Smack have been recovered from the possession of petitioner. It is submitted on behalf of petitioner that no such recovery has been made and the quantity of smack has not been verified. Petitioner is in custody since 07-02-2020. However, learned A.P.P. for the State has vehemently opposed the bail application and submitted that 18 small packets

Patna High Court CR. MISC. No.35527 of 2020(2) dt.22-12-2020 2/2 of smack has been recovered from the possession of petitioner as well as petitioner has got criminal antecedent and he is accused in four more cases.
