The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.

The brother of the deceased disclosed that his brother was missing. His brother had gone to Paithan Patti for the purpose of appointment on the post of teacher. His brother was found lying on a cot and his neck was slit. There is no eye witness of the occurrence. The informant suspected the hand of the petitioner and one Abdul Matin. The police after investigation submitted final form due to lack of evidence but cognizance was taken. Similarly situated accused Abdul Matin has already been enlarged on bail vide order passed in Cr. Misc. No. 44793 of 2015.

No.45524 of 2015 (2) dt.30-09-2015 2/2 Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri S. K. Srivastava, learned Judicial Magistrate, 1st class, East Champaran at Motihari in Chhauradano P.S. Case No. 61 of 2010.
