JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being the mother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code. The accusation is of killing the sister of the informant after 12-13 years of the marriage for non-fulfillment of the dowry demand.

It is submitted by learned counsel for the petitioner that the thrust of accusation of demand of dowry and torture is against the husband of the victim. The postmortem report reflects no external injury and since the cause of death has not been ascertained, hence viscera has been preserved. The impugned order also does not suggest any direct material against the petitioner.

No.2540 of 2016 (2) dt.18-01-2016 2/2 Considering the thrust of accusation against the husband of the informant and the petitioner being a lady, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties Sub-Judge-XI-Cum ACJM, Purnea in connection with Amour P.S. Case No. 179 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
