The petitioner seeks bail in Bettiah Muffassil (Banuchappar) P.S. Case No. 547/2014 registered for the offence under Section 302 and other sections of the Indian Penal Code. The informant suspected that the petitioner and others must have killed his brother Chunnu Kumar, as Akhilesh Ram and Madan Ram had some altercation with Chunnu Kumar. Both of them had given threat to him.
It appears that there is no eye-witness of the occurrence. The name of the petitioner figured in the case on mere suspicion. Similarly situated co-accused, Ranjan Ram and Pramod Ram have already been enlarged on bail.
Patna High Court Cr.Misc. No.45756 of 2015 (2) dt.01-10-2015 2/2 However, learned A.P.P. vehemently opposed the prayer for bail.
Taking into consideration of the facts that except suspicion there appears no tangible material, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned IIIrd Addl. Sessions Judge, Bettiah, West Champaran in connection with Bettiah Muffassil (Banuchappar) P.S. Case No. 547/2014.
