JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 341, 354, 354B, 498A and 448/34 of the Indian Penal Code. The basic accusation is of torture. It is specifically alleged that co-accused Ganauri Mandal and Rabindra Mandal forcibly entered into the house of the complainant, assaulted her and outraged her modesty.
It is submitted by learned counsel for the petitioner that the petitioner is the distant relative of co-accused Rabindra Mandal, hence the petitioner cannot be treated to be the family member of the husband of the complainant.
Considering the relationship of the petitioner and the

No.4311 of 2016 (3) dt.05-02-2016 2/2 complainant, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhagalpur in connection with Complaint Case No. 2431 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
