Diary in the present case was called for, which has since been received.

The petitioner is in custody since 28.07.2015 in connection with Konch P.S. Case No. 98 of 2015, registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is the unfortunate widow of the deceased, who has been roped in the present case only on account of the fact that she did not lodge the F.I.R. against the guilty persons. Learned counsel for the State after perusal of the several

Patna High Court Cr.Misc. No.45499 of 2015 (5) dt.09-02-2016 2/2 paragraphs of the case diary stated that the petitioner in her confessional statement stated that she could not create hulla out of fear even though she was aware that they were brutally assaulting her husband.

Considering the aforementioned facts and circumstances, the period of custody and that whatever has been submitted by the petitioner is in her own confessional statement before the Police, which has no evidentiary value and also that the petitioner has no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Konch P.S. Case No. 98 of 2015.
