2. In the present case, the petitioner seeks bail in connection with Rajapakar P.S. Case No. 363 of 2024 registered for the offences under Sections 97 and 143 of the BNS.

3. As per prosecution case, petitioner's mother informed the police about petitioner bringing 8 months old girl to her house. Subsequently, it came to the notice of the police that petitioner has stolen a girl from a running train in order to sell her.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. No occurrence as alleged has ever taken place. Petitioner has made accused at the instance of

Patna High Court CR. MISC. No.33944 of 2025(3) dt.04-09-2025 2/3 his hidden enemies. Nothing incriminating has been recovered from the person or possession of this petitioner. No cogent material has come on record to show the involvement of this petitioner in the offence as alleged. Petitioner is in custody since 06.10.2024 and charge-sheet has been submitted. Petitioner is having clean antecedent.

5. Learned A.P.P. opposes the submission made on behalf of the petitioner. Learned APP submits that petitioner's mother informed the police about the activities of the petitioner and the petitioner was apprehended by co-villagers.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner as well as submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate1st Class-cum-Additional Munsif-7th, Vaishali at Hajipur/concerned court in connection with Rajapakar P.S. Case No. 363 of 2024, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions: (i) One of the bailors will be the parents of

(ii) The petitioner will remain present on each and every date fixed by the court below.
