The petitioner is languishing in custody since 05-10-2018 in a case registered for the offences punishable under Sections 30(a), 33, 35 and 38 of the Bihar Prohibition and Excise Act, 2016.

It is alleged that from the house of the petitioner, 54 litres of Indian Made Foreign Liquor were recovered. The petitioner is accused in one other case under the Bihar Prohibition and Excise Act, 2016.

It is submitted by learned counsel for the petitioner that recovery has been made from joint family of the house of the petitioner.

Learned APP submits that recovery has been made from

Patna High Court CR. MISC. No.34798 of 2019(2) dt.28-05-2019 2/2 the house of the petitioner.

Considering the nature of recovery, the fact that investigation has already concluded and the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, West Champaran at Bettiah in connection with Bettian Town P.S. Case No. 858 of 2018.
