The matter has been taken up through video conferencing.

The petitioners seek bail in Laukaha (Lalmaniya) P.S. case No. 206/2020 registered u/s 399, 400, 402 of the IPC and u/s 25(1-B)a, 26/35 of the Arms Act.

The informant apprehended the petitioners while moving on different vehicles after getting information that the miscreants were moving around for committing cognizable offence and on being search loaded one country made pistol with one live cartridges were recovered from possession of both the petitioners.

No.28214 of 2020(3) dt.14-12-2020 2/2 The learned counsel for the petitioners submits that petitioners are in custody since 30.07.2020 and the petitioners have remained in custody for about four and half months and they have got no criminal antecedent. It is the first case in which the petitioners have been made accused. It is further submitted that the arms were also transplanted.

Taking into consideration the facts that the petitioners have remained in jail for about four and half months and they have got no criminal antecedent, the petitioners, above named, are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Sri S. Kumar, the learned Judicial Magistrate, 1st class, Jhanjharpur, Madhubani in connection with Laukaha (Lalmaniya) P.S. case No. 206/2020. (Prabhat Kumar Jha, J) BKS/- U T
