JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 24-11-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of regular bail arises out of Rail P.S. (Rajendra Nagar Terminal) P.S. Case No.221 of 2015, disclosing offences under Sections 379 and 411/34 of the Indian Penal Code.

The petitioner is in custody since 20.06.2015. Allegedly, from his possession, a stolen mobile phone was recovered by the police.

Patna High Court Cr.Misc. No.49071 of 2015 (2) dt.24-11-2015 2/2 Learned counsel, appearing on behalf of the petitioner, submits that the petitioner has no criminal antecedent and there is no chance of the petitioner tampering with the evidence as the investigation has already been concluded.

Considering the nature of accusation and the period of petitioner's custody, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Ist Class, Patna, in connection with Rail P.S. (Rajendra Nagar Terminal) P.S. Case No.221 of 2015 (G.R. No.313 of 2015.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
