ANJANA MISHRA ORAL ORDER 12-02-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Agiaon Bazar P.S. Case No. 49 of 2015, registered for offences punishable under Sections 341, 323, 307, 504 and 34 of the Indian Penal Code.

Diary in the present case was called for, which has since been received.

Learned counsel for the petitioner submits that though there is an allegation against the petitioner that he had attacked one Guddu Kumar on his head, the injury report indicate that the said Guddu Kumar had sustained injuries on the head but they are found to be simple in nature.

No.1677 of 2016 (4) dt.12-02-2016 2/2 Learned counsel appearing on behalf of the State after verifying the said fact from the case diary submits that it is evident from the paragraph 37 of the case diary that initially the wound was found on the skull of the said Guddu Kumar but subsequently after X-Ray and other examinations, the said injury was found to be simple in nature and caused by hard and blunt substance.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent and the occurrence took place on account of existing land dispute between the parties, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Dinkar Kumar, Judicial Magistrate, Bhojpur at Ara in connection with Agiaon Bazar P.S. Case No. 49 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
