JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-08-2019 Petitioners seek bail in anticipation of their arrest in connection with Magadh University P.S. Case No. 19 of 2019 registered for the offences punishable under Sections 413, 414, 34 of the Indian Penal Code and Section 11(b)(e)(f) of the Animal Cruelty Act.

Police on secret information intercepted two trucks and driver of one of them was arrested, who disclosed the name of other driver, who succeeded in fleeing away and total 25 animals were recovered from the trucks.

Submission of learned counsel for the petitioners is that they are driver and owner of the truck and animals were purchased from the Krisi Bazar, Lohardaga and receipt of the

Patna High Court CR. MISC. No.34380 of 2019(3) dt.02-08-2019 2/2 same is annexed as Annexure-2 by one Rizwan Ansari and carried by the petitioners.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IX, Gaya, in connection with Magadh University P.S. Case No. 19 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
