The petitioner apprehends his arrest in connection with Chakmehsi P.S. Case No. 06 of 2019, registered under Sections 341, 504, 506 and 307/34 of the Indian Penal Code. The accusation is that in the evening of 08.01.2019, informant, Arbind Thakur, was going to flour mill. In the way near the Shiv Temple, the petitioner and Rajnish Tahkur were present. When the informant attend the call on mobile then petitioner came in suspicion that informant is giving information to police about their illicit liquor business and opened fire through pistol but the same was not hit to the informant. Thereafter, information was given to the police station and the police came there and recovered two empty cartridges. When the police moved from there then they again

Submission is that the petitioner has also been implicated in Chakmehsi P.S. Case No. 125 of 2017 registered under Sections 323, 324 and 504/34 of the Indian Penal Code lodged by concerned Rajnish Thakur and the present case has also been lodged only to give under pressure. Further submission is that while the allegation of making firing has been made against the petitioner but none has sustained injury.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Samastipur, in connection with Chakmehsi P.S. Case No. 06 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
