The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 354B, 504, 506 of the Indian Penal Code.

Accusation is of outraging the modesty of the informant.

It is submitted by the learned counsel for the petitioner that the maternal uncle of the petitioner lodged a case against the informant's side on 17.10.2015 at 9.00 A.M. for which the information was given to the police, but it was interpolate and got registered on 18.10.2015 at 8.00 P.M. The overwriting is apparent on the upper portion of the First Information Report as contained in Annexure-2. Overwriting was made to got the present case registered on 18.10.2015 at

Patna High Court Cr.Misc. No.1856 of 2016 (2) dt.15-01-2016 9.30 A.M. when the information was given by the present informant on 18.10.2015 at 9.15 A.M. for the occurrence of 17.10.2015 at 7.30 P.M. It further transpires that the date of occurrence has also been interpolated in the written report. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Considering the case lodged by the petitioner's maternal uncle at earlier point of time, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sri R.R. Raman, J.M., Ist Class, Bhagalpur in connection with Antichak P.S. Case No. 38 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
