The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 468, 471 and 474 of the Indian Penal Code.
The prosecution case is that the petitioner being the Headmaster of the school in connivance with coaccused Sudhanshu Kumar, Ramesh Kumar and Rajesh Kumar issued forged school leaving certificate by entering date of birth of the son of the informant namely, Mitranjan Kumar whereby he was declared major who executed the sale deed in favour of the aforesaid three persons.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.7386 of 2016 (2) dt.18-02-2016 2/2 petitioner that the school leaving certificate entering the wrong date of birth of the son of the informant was issued under some mistake when the said school leaving certificate was cancelled by the petitioner when the petitioner gave notice to the informant at earlier point of time.
Considering the thrust of accusation against co-accused persons coupled with the statement made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Parsa Bazar P.S. Case No. 23 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
