The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 120(B) and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that petitioner who was Mukhiya in between 2011 and 2016 committed illegality in appointment of Panchayat Shikshak by not following the direction of this Court in C.W.J.C. No. 3574 of 2009.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that all the appointments made during her tenure
Patna High Court CR. MISC. No.36172 of 2022(2) dt.29-11-2022 2/2 were genuine as the documents were sent to the authorities for verification, it is also submitted that had an opportunity been given to the petitioner before instituting an FIR seeking her explanation then perhaps the present FIR would not have been instituted.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Ben P.S. Case No. 94 of 2017 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
