2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 420 of the Indian Penal Code.

3. The case of the prosecution based on the complaint petition is that the complainant watned to run a business of aluminium foil container. The petitioner was paid a sum of Rs.27,60,000/- and he was introduced by co-accused Pankaj Kumar Sinha and Niraj Kumar Sinha but the machine never

4. Learned counsel for the petitioner has submitted that from same facts two case has been filed. One is based on complain and another is based on FIR and in that case which is based on FIR the bail of this petitioner has been rejected by the learned Co-ordinate Bench.

5. Learned counsel for the petitioner has undertaken to supply the machine if the petitioner is granted provisional bail.

6. Learned counsel for the complainant is present and he has got no objection to the undertaking of learned counsel for the petitioner.

Considering the above facts and circumstances of the case, this Court is inclined to enlarge the petitioner on provisional bail with the condition that after coming out from the custody the petitioner will supply the machine within three months to the informant. The above named petitioner is directed to be enlarged on provisional bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the court of learned A.C.J.M.- VIIth, Aurangabad in connection with Complaint Case No. 837

8. Accordingly, the present bail application stands allowed.
