Office has pointed out defect regarding rejection order of the Court below.

It has been mentioned in paragraph no. 15 of the bail petition that petitioner moved before the Court below on 12.06.2017, but District and Sessions Judge, Begusarai orally stated that the anticipatory bail application is not maintainable under the Bihar Excise New Amendment Act.

Even if Anticipatory Bail application is not maintainable under the aforesaid Act, the Court below should have passed an order to that effect.

In view of the above, petitioner is directed to file Anticipatory Bail application before the Court below afresh and the Court below is directed to dispose of expeditiously the same. (Arvind Srivastava, J) U T Shailendra/-
