Learned counsel for the petitioners, at the outset, seeks permission to withdraw the present anticipatory bail application with respect to petitioner no.1, Rinku Devi. Permission is accorded.

The petitioner no.2 apprehends her arrest in a case registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

The informant alleges that Rinku Devi informed him on phone that his daughter Sindu Devi and son-in-law Gautam Yadav have reached his house or not. The informant on getting

No.46763 of 2021(4) dt.03-08-2022 2/3 this information went to Sitakund Nayatola at about 12 noon and thereafter he along with his family members started searching his daughter and son-in-law and later came to know that a dead body is lying near bank of river Ganga at Gorghat Bariyarpur which was identified as of his daughter thus it was alleged that the son-in-law along with his family members has killed his daughter by throwing her body in the river. Learned counsel for the petitioners submits that the petitioner is a woman having clean antecedent and has been falsely implicated in the present case, petitioner is sister-in-law of the deceased and during the course of investigation it has come that the son-in-law of the informant was having illicit relationship with Rinku Devi (sister-in-law of the deceased) on account of which the present occurrence took place. It is further submitted that during the course of investigation also nothing has come which could even connect the petitioner with the offence except suspicion.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner number 2, in the event of her arrest or surrender before the learned Court below

Patna High Court CR. MISC. No.46763 of 2021(4) dt.03-08-2022 3/3 within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Muffasil P.S. Case No. 257 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
