08-12-2015 Heard Sri Ajay Kumar Singh-I, learned counsel for petitioners and Smt. Renu Kumari, learned Addl. Public Prosecutor.

Two petitioners, who are in custody since 08-11-2014 in Patrakar Nagar P.S. Case No. 272 of 2014 registered for the offence under Sections 376, 511/34 of the Indian Penal Code and Section 25(1-B)a, 26/35 of the Arms Act, 1959, have prayed for grant of bail, primarily on the ground that one of the co-accused namely Vicky Kumar, from whose possession two live 315 bore cartridges were recovered, has already been granted bail by this Court on 23-06-2015, vide Cr. Misc. No. 18968 of 2015. Learned Addl. Public Prosecutor has opposed the

Patna High Court Cr.Misc. No.52573 of 2015 (2) dt.08-12-2015 2/2 prayer for bail.

Keeping in view the nature of accusation and period of custody as well as the fact that one of the co-accused almost similarly situation has been granted bail, let both the petitioners namely Rajneesh Kumar @ Rajneesh @ Sagar and Rakesh Kumar be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge IX, Patna/concerned court in connection with S. Tr. No. 54 of 2015 (arising out of Patrakar Nagar P.S. Case No. 272 of 2014). (Rakesh Kumar, J.) Anay U T
