2. Petitioner seeks bail who is in custody since 03.06.2022 in connection with Sessions Trial No. 850 of 2022 arising out of Kudhani P.S. Case No. 257 of 2022, F.I.R. dated 22.05.2022 for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. Earlier the regular bail application of the petitioner was rejected by a Co-ordinate Bench of this Court vide order dated 24.07.2023 passed in Cr. Misc. No. 26522 of 2023.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case.

5. Vide order dated 02.08.2024 a report was called with regard to the present stage of trial. Report of the learned Trial Court dated 09.08.2024 reveals that the evidence of the parties stands concluded and now the case is fixed for the defence argument.

6. The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner.

7. Considering the report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail in connection with Sessions Trial No. 850 of 2022 arising out of Kudhani P.S. Case No. 257 of 2022 pending in the court of learned 3rd Additional Sessions Judge, Muzaffarpur.

8. Prayer is refused.

9. However, learned Trial Court is directed to expedite and conclude the trial at the earliest.
