Heard the learned counsel for the petitioner and learned APP for the State.
The petitioner apprehends her arrest for the offences alleged under Sections 419, 420, 467, 468, 471, 120-B and 379/34 of the Indian Penal Code, registered in connection with Sasaram (T) P.S.Case No. 96 of 2021.
As per allegation, the entire compensation amount of land acquisition, including the structure thereon, was transferred into the account of the present petitioner. Later on, the acquisition authorities came to know that the petitioner was not the owner of the structure situated on that land. They asked the petitioner to return the compensation awarded to her mistakenly for the structure existed on the land, but she refused and thereafter Certificate Case No. 01 of 2021 was instituted. Patna High Court CR. MISC. No.45310 of 2021(3) dt.18-04-2022 2/2 petitioner has submitted that the said structure falls in the share of the land of the petitioner purchased from one Ashok Singh. Moreover, the acquisition authorities have already filed the said certificate case pending in the court of Certificate Officer, Rohtas, which is pending, for recovery of that amount. Considering the above facts and circumstances, let the petitioner above-named, in the event of her arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram in connection with Sasaram(T) P.S.Case No. 96 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
