Heard learned counsel for the parties.
This application has been filed for modification of the order, dated 31.03.2016, passed in Cr. Misc. No. 7720 of 2016, whereby the petitioners had been granted anticipatory bail and were directed to surrender before the learned Court below within a period of six weeks from the date of the order. Learned counsel appearing on behalf of the petitioners, while praying for extension of time to surrender, submits that the petitioners could not surrender before the learned Court below within the stipulated time granted by this
Patna High Court CR. MISC. No.46151 of 2021(2) dt.25-08-2021 2/2 Court as the petitioners are illiterate and petitioner no. 1 works as labourer and remains out of State for his livelihood and they were not aware that after grant of anticipatory bail they were required to furnish bail bonds before the learned Court below. Having regard to the submissions made on behalf of the parties, the time granted to the petitioners to surrender before the learned Court below for furnishing bail bond by order dated 31.03.2016, passed in Cr. Misc. No. 7720 of 2016, is hereby extended by four weeks from today.
This application is allowed with the modification as above.
