JUSTICE ARVIND SRIVASTAVA ORAL ORDER 18-08-2017 Heard learned counsel for the petitioner and learned counsel for the State.
Petitioner seeks bail in connection with Bettiah City P.S. Case No. 237 of 2017 registered under Sections420/406 of the Indian Penal Code. After some argument, learned counsel for the petitioner submits that petitioner may be granted provisional bail for depositing half of the cheque amount in question, which may be kept subject to the result of the case.
Learned counsel for the informant has no objection to the above submission.
Considering the facts and circumstances of the case, the petitioner above named is directed to be released on
Patna High Court Cr.Misc. No.37187 of 2017 (2) dt.18-08-2017 provisional bail for a period of three months on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran at Bettiah in connection with Bettiah City P.S. Case No. 237 of 2017.
It is made clear that in case petitioner deposits half of the cheque amount i.e. Rs. 3,50,000/- within a period of three months from the date of release, the Court below will confirm the provisional bail granted to him. In default, Court below shall take steps for cancellation of his bail bonds. The deposited amount will be subject to the result of the case.
