JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of regular bail arises out of Patrakar Nagar P.S. Case No.157 of 2015, disclosing offences under Section 392 of the Indian Penal Code. The petitioner is in custody since 12.06.2015. It is submitted by learned counsel, appearing on behalf of the petitioner, that he has been arrested merely on the basis of a suspicion that the motorcycle, which he was

He has submitted that though the informant is said to have seen the persons, committing the crime, till date the petitioner has not been put on T.I. Parade. He also contends that nothing incriminating has ever been recovered from his possession and that the petitioner is a student of B.A. course in B.N. College, Patna. Considering the period of custody, which the petitioner has undergone, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna, in connection with Patrakar Nagar P.S. Case No.157 of 2015.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
