Petitioners apprehend arrest in a case registered for the offences punishable under Sections 142, 143, 147, 148, 149, 307, 323, 325, 333, 353, 427 and 435 of the Indian Penal Code. It is alleged that the petitioners, being member of the mob of about 400 to 500 persons, were indulged in a protest against the local administration over the road accident claiming life of three persons.

Learned counsel for the petitioners submits that there

No.34636 of 2019(2) dt.28-05-2019 2/2 is no specific allegation against these petitioners and similarly situated co-accused persons, namely, Ashok Kumar Singh, Manishankar Kumar, Ajay Kumar Mandal and Birju Mandal have already been allowed anticipatory bail by different benches of this Court vide orders dated 16.5.2019 and 15.5.2019, passed in Cr.Mis.No. 32337 of 2019 and 32352 of the 2019. Considering the facts of the case, let these petitioners, above named, in the event of arrest/surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.

10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st Class, Rosera, Samastipur in Hathori (Shivajee Nagar OP) Police Station case no. 16 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioners.
