2. The petitioner has preferred this application for grant of regular bail in connection with Town(Kadirganj OP) P.S. Case No. 1226 of 2023 dated 03.08.2023 registered for the offence/s punishable u/ss 341, 323, 504, 506 and 307 read with section 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have abused the informant's wife by calling her Daain and when the informant protested, the petitioner assaulted him with Tangi causing injury on his head and all the accused persons also assaulted him with lathi-danda.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this

Patna High Court CR. MISC. No.38841 of 2024(2) dt.04-07-2024 2/2 case. The petitioner is own nephew of the informant and the present occurrence took place due to land dispute between the parties. Nothing has been recovered from the conscious possession of the petitioner. There is no repetition of blow. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 04.03.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the anticipatory bail petition of the petitioner was earlier rejected by this court vide order dated 19.02.2024 passed in Cr. Misc. No. 2806 of 2024.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Nawada in connection with Nawada (Kadirganj) Town (Kadirganj O.P.) P.S. Case No. 1226 of 2023.

7. The application stands allowed.
