This application is for grant of regular bail in connection with Ara Muffasil P.S.Case No.284 of 2016 dated 21.10.2016 for the offences under Sections 302 and 380/34 of the Indian Penal Code.
Allegation against the petitioner and the other accused persons is of demand of Rs.50,000/- and the allegation against the petitioner is of firing on the deceased causing his death and also of taking away of Rs.02 lac.
Submission of the learned counsel for the petitioner is that earlier the FIR had been lodged stating that at the instance of Umesh Rai, the petitioner has fired and later on the informant filed a protest petition stating hat she has not named Umesh Rai.
Patna High Court Cr.Misc. No.51215 of 2017 (6) dt.01-10-2018 2/2 The petitioner is in custody for two years.
Heard learned A.P.P. also.
Having heard both sides and in view of the fact that, I am not inclined to grant bail to the petitioner at this stage, however, since he is in custody for more two years, the learned trial court is directed to expedite the trial. With the aforesaid observation, this application is dismissed.
