The petitioner apprehends his arrest in connection with Raushanganj P.S. Case No.124 of 2019, registered for the offences punishable under Sections 420, 409 and 34 of the Indian Penal Code.

Prosecution case relates to not completion of work in a Gram Panchayat under the scheme of Nal-Jal Yojana of which petitioner is Secretary.

Learned counsel for the petitioner filed a supplementary affidavit today in Court and in paragraph-2 of the supplementary affidavit, it is stated that the entire pending work has been completed and the Technical Assistant (J.E.) of the Panchayati Raj Department, Government of Bihar issued the

Patna High Court CR. MISC. No.53272 of 2021(4) dt.23-06-2022 2/2 measurement book which shows that the assigned work has been completed. It is submitted that there is general and omnibus allegation against the petitioner and similarly situated co-accused, Suryadeo Yadav has already been enlarged on anticipatory bail by a co-ordinate Bench of this Court vide order dated 20.06.2022, passed in Cr. Misc. No.46402 of 2021. Taking into consideration the facts aforesaid and the fact that similarly situated co-accused person has already been enlarged on anticipatory bail by a co-ordinate Bench of this Court, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.

25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sherghati, Gaya in connection with Raushanganj P.S. Case No.124 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Proceudre. (Anjani Kumar Sharan, J.)
