JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 08-10-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of regular bail arises out of Kishanpur P.S. Case No.97 of 2015, disclosing offences under Sections 379 and 411 of the Indian Penal Code.

The petitioner is in custody since 12.06.2015 and has no criminal antecedent. Learned counsel, appearing on behalf of the petitioner, submits that petitioner shall be presenting himself before the court below as and when required. He has also submitted that one of the co-accused, namely, Md. Alam, has been granted the privilege of regular bail by this Court vide

Patna High Court Cr.Misc. No.46021 of 2015 (2) dt.08-10-2015 2/2 order dated 22.09.2015, passed in Cr. Misc. No.43482 of 2015.

In the facts and circumstances of the case, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Kishanpur P.S. Case No.97 of 2015.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
