2. The petitioner is in judicial custody in connection with Aurangabad Town P.S. Case No. 129 of 2021 for the offence punishable under Sections 420, 406 read with 34 of the Indian Penal Code lodged on 05.04.2021 by the informant, Rajesh Kumar Singh.

3. As per the prosecution story, the informant who wanted to run a business relating to aluminum foil container, the petitioner was paid a sum of Rs. 27,60,000/- when he was introduced by co-accused, Pankaj Kumar Sinha and Neeraj

Patna High Court CR. MISC. No.41320 of 2024(5) dt.10-01-2025 2/2 Kumar Sinha but the machine never reached the place of the informant which led to the FIR.

4. Learned counsel for the petitioner submits that though interim relief was granted to him to explore the return of the amount, as he could not do so, at the end of the period, has surrendered and is now in jail.

5. Considering the submissions put forward by the parties as also the cheating intent of the petitioner which reflects from the FIR itself, though this Court gave a long rope to the petitioner to remove the said perception that he has cheated the complainant, it seems the petitioner has other ideas.

6. In that background, no relief can be granted. The bail application stands rejected.
